Welcome to www.sublimevintage.co.uk (herein after "Sublime Vintage" "Company" or "Site"). By using this Site, you agree to be bound by and comply with these terms and conditions ("Terms and Conditions"). You also agree to comply with any guidelines or rules posted on the Site regarding any product or service offered on the Site. All such guidelines and rules posted are hereby incorporated by reference into these Terms and Conditions. Please read them carefully.
This website is owned and operated by Nigel Patrick Gray for Sublime Vintage. These Terms set forth are the terms and conditions under which you may use our website and services as offered by us. This website offers visitors original Artwork, Textiles, Gifts, Personalised gifts and home furnishings. By accessing or using the website and our service, you approve that you have read, understood, and agree to be bound by these Terms.
Who can use our website;
In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When you visit Sublime Vintage, purchase products or services through the Site, or email the Company, you are communicating with us electronically. You consent to receiving communications from us electronically. We will communicate with you via email, text message or by posting notices on and updates to the Site. By using the Site, you hereby agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We welcome your feedback about the Site. However, any comments, ideas, notes, messages, suggestions or other communications sent to the Site shall be and remain the exclusive property of the Company, and we may use all such communications in any manner, including reproducing, disclosing and publishing such communications, all without compensation to you.
Placing an order:
Before submitting your order, please ensure you are in agreement with the following terms of sale:
Any and all text on your presonalised project has been checked for spelling and grammatical errors.
Any and all photos for your personalised project have been selected and uploaded with details of the invoice number and product to be used on.
If we receive a “poor quality” photo or text that may not print correctly we will not go ahead and print without prior approval from the client.
Please ensure any optional extras are added / removed as required.
Please ensure your shipping address is complete and correct. Any orders shipped to incorrect addresses provided will incur re-printing & re-shipping Charges.
Confirming, Cancelling and Changing your order:
Personalised products: once you have submitted your order and the project(s) has been agreed a confirmation email will be sent. Any information or images provided that are not suitable for printing or the product is out of stock and an alternative is not available we will notify you by phone or email before any substitute is made or alternative artwork or photos are required . Should you wish to cancel your the order, you must do so within 1 business day of placing your order by telephone on 01273 307135 or by email to email@example.com. If an orders print process has started we reserve the right to charge a cancellation fee to the total value of the order to cover the potential wastage and re-processing & handling (in case of amended orders).
For personalised orders that have already been shipped, you cannot return these items as they have no resale value.
ORDER AND PAYMENT TERMS
Terms of payment are within the Company's sole discretion, and unless otherwise agreed in writing, payment must be received by the Company prior to acceptance of an order. The Company may accept payment via Visa, MasterCard, American Express and PayPal (other forms of payment may be added or removed at Company's sole discretion).
When buying an item, you agree that:
you are responsible for reading the full item listing before making a commitment to buy it:
you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The Companies acceptance of your order is on your agreement to these Terms and Conditions and Site Terms, as set out on these pages. We reserve the right to recover any monies outstanding, should we find any initial payments that did not go through at the time of transaction due to any technical error. All products and services remain the property of the Company until full payment is received.
Unless other arrangements or contact has been made the Company will make best efforts to dispatch merchandise within a maximum of 3 to 5 working days from the receipt of a properly completed order. Tracking will be made available for parcels and any parcels not delivered must be notified by Email, phone or letter,the Company shall not be liable for any loss, damage, cost or expense related to any delay in dispatch or delivery caused by the chosen delivery agents.
RETURN, REFUNDS AND EXCHANGE CONDITIONS
As the Company’s personalised merchandises are made to order and has no intrinsic value on the open market, the Company is therefore unable to accept returns unless the merchandise is at fault. For personalised merchandise which is at fault, or differs from that ordered, the customer must contact Support by email on firstname.lastname@example.org and a suitable replacement will be sent within 24 hours
If requested by the Company the customer must return the original merchandise to the Company within 7 days of receipt of the order along with the original invoice or a copy of the original invoice. If no invoice is to be had, please include a letter specifying the problem, including date of purchase, the first and last name, and your phone number. The customer shall return the merchandise to the Company in the original packaging as supplied, please allow standard delivery timing of 3-5 business days for the return to arrive before any arrangements are made for a reprint to be dispatched and any problems, or concerns regarding the return. The Company will not provide reimbursement for shipping & handling charges once the order has entered the delivery process.

Any order returned back to Sublime Vintage as being not delivered will be stored for up to 1 month and the customer will be contacted via phone and email. If the customer does not contact us back within 1 month, Sublime Vintage will dispose of the order and the order will be treated as cancelled. Kindly note, if an order has been returned as not delivered and the customer(s) request a redelivery they will be charged a delivery fee of equal amount as the original delivery charge paid by the customer while placing the order. Please note orders cannot be replaced, refunded or reprinted after 30 days of dispatch.
We will replace any item that has a manufacturer design fault, Personalised Photo Products that have a fault due to the wrong information being provided by the client is not entitled to a refund or replacement it is at the discretion of the company. Please also note that we will compare your order with original images and text uploaded to check the quality difference. If the image is of poor quality, we will not be able to reprint or replace your order. Please note we retain the right to ask for an image or product to be returned back in order to confirm the error/ damage/ issue on product.
The customer may not assign its rights or obligations hereunder without the express prior written consent of the Company.
GOVERNING LAW, JURISDICTION AND COSTS
This agreement is governed by the laws of the United Kingdom, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the United Kingdom is an appropriate place for venue of any litigation and that United Kingdom courts have jurisdiction over this agreement and customer. In the event the customer and Sublime Vintage are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable attorneys’ fees incurred.

Limited Warranty of Product and Site:
The returns policy provided does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, improper storage, extreme temperatures, acts of nature or improper installation or repairs. Such limited warranty only extends to refunds or replacements of Sublime Vintage Products. The customer expressly understands and agrees that the products and services provided are on an "as is" and "as available" basis. All product specifications, images and other information published on the Company’s website have either been made accessible by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. The intention of the Company is that all the information on the website should be as accurate and up to date as possible. However, the Company cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual. In the event a product is listed at an incorrect price due to a typographical error or error in pricing information from the Company’s suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges). The customer accepts full responsibility for keeping their account password confidential, restricting access to their computer and keeping the e-mail address associated with their account current. You are personally liable for any orders that the customer places or charges that are incurred. Periodically, links may be established from the Company’s website to one or more external websites, these links are provided for the customer’s convenience only. None of such links should be deemed to imply that the Company endorses the Third Party Sites or any content there in.
TERMS AND CONDITIONS
This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by the customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control.
Should any Additional, Different or Conflicting terms and conditions on any such document issued by a customer at anytime are hereby objected to by the Company (Sublime Vintage) and as such shall be wholly inapplicable to any sale made here under and shall not be binding in any way on the company (Sublime Vintage)
